Microsoft, a productive company. I'm not discounting the
narrative, only that it should apply to NPEs separately. It
may very well be that the patent bargain is generating too
many patents but not enough real invention and investment in
R&D, but there aren't that many studies that look at the ex
ante side - they only look at the ex post side. Of course
NPEs don't fulfill the bargain currently, but we don't know
what would happen if we stopped allowing
alienability/licensability of patents that aren't practiced.
Maybe nothing - other countries have "working requirements"
for example, but maybe we should look at per capita
investment in R&D in countries that have working
requirements, for example.
