The effect of programming

Yes, programming the PROM physically changes it, but I don't think Doing
so creates a new device.

A PROM is not a computer. Even if programming the PROM were to create
a new machine, I don't see how that translates into the computer into which
the PROM is installed into becoming a new machine.

A stored program computer must use erasable memory. Let me know when you find a
computer which replaces its RAM with PROM and still works as designed.

Besides machine structure is not physical structure in a broad sense. The
structure mentioned in this argument is the structure of the machine, not some
other kind of structure.

This line of argument also means that supplying current to a
light bulb creates a new machine.

50 computer languages

each will do stuff slightly different and thus you get the
same result with 50 different ways....
the zeros and ones of binary will be different as the language
tells the kernal how to get there in its own ways.

And you immediately commit the error we are all trying to
correct - you try to make reality conform to legal opinion,
rather than get law to conform to facts. Your argument is
based on flawed legal theory, NOT FACTS.
