Exactly, we don't have to define or figure out what the
"work as a whole" is. Oracle did that for us when they
filled out their copyright application. Now, had they
filled out one for all of java and then also filled out one
for subsections of java, then I could agree that the "work
as a whole" could be the smallest subset that was
copyrighted. In this case, that didn't happen - so the
smallest subset that was copyrighted individually is the
entire set of java. So the work as a whole has to be the
entire language.
And remember that they couldn't claim copyright all of the
smaller subsets because they didn't write all of the smaller
subsets and they don't own the copyright to them all.[ Reply to This | Parent | # ]
