It was included as a critique of one of the more frequently
cited "better than electing judges" alternatives -
appointment. Appointment by majoritarian elected leaders is

Some (I don't know how many) states elect their judges, up to and including
their State Supreme Court judges. Recently there have been a few states where
unpopular judgements have been handed down, followed by political groups either
calling for impeachment or starting campaigns to defeat, at re-election, any and
all judges that favored the unpopular decision. This latter practice
politicizes the state courts, which is, as PJ said, a Bad Thing.[ Reply to This | Parent | # ]
