MS appear to think Motorola weren't very interested in negotiating. I'd agree
with them actually - they (supposedly - I'd love to see the actual offer because
it's hard to tell how much is MS spin) got a multibillion dollar (350m sales *
even $250 sale price for a PC (low!) * 2.25% is >$2bn/year) royalty demand
and a 20 day deadline. For H.264/wifi software patents...
I don't think it's a stretch to conclude that's probably not an invitation to
good faith negotiations. Now there's good reasons for why Motorola did that,
but yeah.
*In isolation* I almost agree with the position MS are taking. *In context*
it's very cynical and they're trying to remove the only avenue Motorola/Google
have to defend against MS's own patent trolling.
As a sidenote, I feel the MS trolling is only really viable because injunctions
are issued far too easily - if MS are prepared to accept a royalty as
settlement, surely they've admitted monetary compensation is enough?[ Reply to This | Parent | # ]
