If that's true (that Apple has simply refused to accept FRAND terms for a
license) then, yes, Samsung should sue and it should be possible to get an
injuction.
However, what we've seen is that Samsung isn't *offering* FRAND terms. (Or at
the very least, Apple doesn't think the terms Samsung is offering are FRAND.)
There is a portion of the suit at issue which has the purpose of determining
whether the terms are FRAND, and if not, what terms would be.
Nice to see the assumption of guilt (despite a lack of evidence) is spreading
