I don't think he was discussing patents. Seemed to me he was
discussing the differences in strategies between the two

But MS being able to use patents while others can not is
also bad.

Check out the way MS competes (and the judgements against
them) and their corporate ethos.
Do the same with Google.
Things can change over time but Google have a huge
investment in having ppl trust them (customers users dev's
partners, governments, etc.), and if they changed then it
would hurt their bottom line.
