I don't know that the bias is deliberate. I
expect he's trying to be even-handed. But
people are people. You saw that in the
Apple v. Samsung jury foreman, who was certain
he'd been fair, when he hadn't even followed
the law.
People are people.
But with a jury, you have a better chance, in
that the odds are more in your favor. The judge
is only one person, after all, so if he has
a bias, you're sunk. The odds of having not
even one fair juror is ... well, between zero
and nothing.
I know. You'll say the Apple v. Samsung jury
wasn't fair, but remember that one guy, the
young guy with the music? He did try, but
in due time he was overwhelmed mainly by a
lack of knowledge when the others followed
the foreman.
It's hard to stand alone, and if you are ever
on a jury, remember that experience. Don't
