IANAL, but if I understand the law about software patents, this is possible in
two manners.

With method claims, it is the execution the infringes. Just having the binary
code doesn't infringe. So you can buy, sell and distribute binaries without
directly infringing. But the guy who runs the code infringes.

With system claims, the doctrine that programming a computer makes a new machine
comes into play. The binary by itself doesn't infringe. But if you load it in
the computer memory you make the new machine and that infringes.
