On this page, you'll find Groklaw's collection of court filings and transcripts from the various SCO litigations, pre- and post-trial court hearings and complete transcripts of the proceedings at the two SCO v. Novell trials in US District Court in Utah, the bench trial in 2008 and the jury trial in 2010, as well transcripts and reports from all the hearings in connection with all the other various SCO litigations, including both SCO v. Novell appeals.

You'll find official PDFs from PACER and Groklaw's unofficial plain text transcripts in all cases. As always, our goal is accuracy and completeness. However, if there are any discrepancies between the PDFs and the text transcripts, rely upon the PDFs. Also, we have transcripts and audio of most of the SCO teleconferences and press conferences since 2003, as well as audio/video and Groklaw transcripts of media interviews with SCO executives, keynotes and other speeches, and panel discussions about SCO. 08-Mar-2010 [PDF] [Text] Day 1 of the SCO v. Novell jury trial held before Judge Ted Stewart. The jury is selected: Voir Dire. 52 jurors are brought in and questioned. 13 jurors (plus one alternate) are sworn in and seated. The judge provides them instructions. The jurors are released for the day, and the actual trial begins the next morning.

Counsel for both sides deliver opening statements, Stuart Singer and Brent Hatch for SCO, Sterling Brennan for Novell, and the trial begins with SCO presenting its case. The jury is released to begin deliberations. At 5:30 p.m., the jury breaks for the week, but will return at 8:30 a.m. on Tuesday morning to continue deliberations. The Court gives cautionary instructions on proper behavior for jurors during deliberations and over the weekend.

30-Mar-2010 The jury meets, after the long weekend, on the following Tuesday and deliberates and then reaches a unanimous verdict in a matter of hours, ruling that the copyrights did not transfer from Novell to Santa Cruz.

Judge Kimball ruled [PDF] on June 16, 2008, that that SCO owed Novell $2,547,817 from the Sun agreement, which it had no right to enter into without Novell approval, but that it did have the right to enter into the Microsoft and other SCOsource agreements, and that SCO had hence breached its fiduciary duty to Novell and converted funds. The ruling came after the same judge ruled on summary judgment motions on August 10, 2007 [PDF, 102 pages] that the copyrights did not transfer from Novell to Santa Cruz and that Novell had the right to waive. The bench trial was to deteine the rest of the issues not decided by summary judgment.
