You should make clear that this is day 6 you are talking about so people don't
get confused and you should probably have put in the off topic section.
Having said that. I find it very, very odd that the judge would say this before
Google has put on their defence. I would want to listen very carefully to the
judges instructions to the jury. Does he say any thing to the jury that helps us
understand why he believes (if he really does) that API's are copyrightable.
It is possible that he is looking for the jury to get him off the hook of having
to decide if API's can be copyrighted. That would be to bad as we should get

Will Judge Alsup instruct the jury on the law of copyright?
It seems he must not have slept well over the weekend worrying
about setting a precedent, and will avoid doing so if
possible.
