What occurs to me is that the whole point about the Apache licence is that
anyone can use the Harmony API implementation without Ellison or Andy Rubin ever
finding out.
Indeed, anyone can use the OpenJDK to write Java programs without anyone
knowing, because of the GPL licence.
Indeed, anyone can use the Sun proprietary API implementation without anyone
knowing because of the Sun binary licence.
The Apache licence is to allow Amazon or B&N to take what they need to
create their own software or device. Why start with Harmony code when Google
have already done the heavy lifting and the marketing, and Android is freely
available?
That is, of course, also under an Apache licence for anyone to use, any way they
like, in secret, as long as they don't infringe on Google trademarks.
Oracle asked the question to mislead the jury.
