Exactly,
Google couldn't bring up the issue until Oracle made a statement in trial, on
the record, being specific about what they were claiming. As we all know,
they've been weaseling around the entire pre-trial trying to get to trial
without ever giving anything solid about what they are claiming (typical BSF
chicanery).
So Goggle literally couldn't bring this up until and unless Oracle brought it up
at trial. Oracle brought it up, Google needed a day to fully doss out their
petition to the court. They submitted it the next day, and Judge Alsup talks to
them about it on the following day.
Perfect time line.

I will be the first one to admit I am noth the sharpest tool in the shed when it
comes to what Oracle said - but - what *did* they say on Monday that started off
the fireworks?

This thread has been running in the background throughout the "work as a
whole" discussion.
Google planted a seed, the judge sprinkled a little water on it, and Oracle
jumped for the harvest, never seeing the trap.
