Oracle, choose one:
1. The whole work is the entire Java CD as registered as a complete work.
2. There are 37 whole works as contained in the collective work registeration
(the Java CD).
In the first case, Oracle's claims become insignificant. Essentially Oracle is
limited to argue "Out of the entirety of Java, Google copied 37 APIs and a
few lines of code".
In the second option, Oracle's case fails because they presented no evidence of
ownership of any of the 37 individual whole works. They can't downward bootstrap
ownership of the collection to the separate works contained therein. Oracle
needed to present evidence of ownership of each accused entire work.[ Reply to This | Parent | # ]
