Don't forget to add that Google also brought to the fore the lack of 'marking'
by Sun and Oracle on their 'products' foreclosing their ability to claim damages
prior to bringing suit. This must scare the bejabers out of potential patent
trolls.
I am also somewhat surprised that Oracle's spoliation of Sun's website hasn't
been raised by Google (yet).
Another thing that strikes me as odd, is that as we learn that Sun didn't
actually create the whole of Java (more and more of these ethereal and
mysterious portholes (sorry orifices (sorry APIs)) seem to have been contributed
by third parties), and since they were contributed over time, and since they
don't transfer copyright to Sun under my reading of the JSPA, how can Oracle
claim that they 'expressed' the structure and selection and possibly the
organization and/or arrangement of the naming of names, classification of
classes, inclusion of methods when they were after-thoughts probably from
another person's mind.
We know that Oracle have acquired SCO's footgun, but can we be sure that they
don't also have access to Blepp's briefcase in the form of a blank CD/DVD filed
with the Library of Congress.
