As the primary owner of a software firm, *ANY* ruling other than APIs are not
protectable expression is bad for business. You can rationalize it away all you
like, but bottom line means anything else means I may have to defend my company
in a court. That means spending money on lawyers. That means less profit,
potential failure of the business, and less income for me and anyone who works
for me.
It doesn't matter that I'll have a positive defense. What matters is I don't
have the money to spend defending lawsuits that the court may not view as
frivolous, and award me damages and court costs, *EVEN* assuming I have the
money to even defend myself anyway!
Ok, so any ruling that gives anyone any reason to file any baseless lawsuit
against my company is bad. Which part of bad are people not understanding?
This has little impact on mega-corporations, with big bucks to defends such
assaults, but a lot small time shops are in real and serious threat here!!!
