If they were direct copies, it would help, because
then Oracle couldn't say they are so sooper creative,
requiring so many man hours and billions in R&D.

Why stop at C? Why not go back through all the generations (B, BCPL, CPL) to Algol [Caveat Lector], the grand-grand-...-daddy of them all? IF any API in Algol is surviving, then clearly they would all be in breach of Copyright (thanks to Mickey Mouse).

The most interesting step in that chain is CPL to BCPL - BCPL [Caveat Lector] is basically (sic) CPL but with lots left out, but importantly done by someone other than the designers of CPL.
