My post was phrased rather hastily due to posting from
a mobile device.
As you note, it doesn't reflect on the legality, but it does
make a clear and definitive statement that Google's
behaviour was within the rules that Sun set regarding
use of the API structure *and* fragmentation thereof.
Google should find a way to get that into evidence, as it

But doesn't the GPL permit anyone to take the just the API and legally
reimplement it under a different license?
