Well, unless the Appeals Court declines to hear the case. I don't think you're
allowed to jump to the Supremes in that case. But however things turn out, I
think there was enough odd stuff that went on during this case that an appeal
will be heard, by either side, so that's probably not an issue.
I just hope that if Google wins on SSO, they remember to appeal any issues that
may still affect them if a higher court overturns that. IIRC, Novell neglected
to appeal on a point that became moot after they won a summary judgment, and it
came around to bite them after SCO won their appeal.
