No one is cut off from supreme court review because an appeals
court decides
not to hear your case.
True enough. Though one's
chances of actually being heard by the Supreme Court significantly diminish if
there are no disagreements amongst multiple circuit Courts of Appeal on similar
cases.
In OraBoggle one of Judge Alsup's options -- of which he is
keenly aware -- is to couch his API/SSO copyrightablitiblit decision in
substantial agreement with the First District's decision in Lotus v
Borland. That would have a lesser chance of being heard by the Supreme
Court than if Judge Alsup were to decide API/SSO is copyrightable, and
if he were to be upheld by the Ninth Circuit Court of Appeals.
