So he is doing the requisite legwork to ensure that his understanding is
rock-solid. He has heard from the tech elite from both sides, and has put
together a very insightful and impressive set of questions for the lawyers to
brief over the course of the trial. In the scheme of things, only the legal part
matters any more, and we are very fortunate to have a judge whose intent

The trick would be to see that the expert that the Judge consulted would be
impartial. For example, would you want him to ask Microsoft programmers to
explain to him whether intellectual property protection needs to be applied to
APIs? I certainly wouldn't.
