compile time = once per version of an application
install
time = (roughly) once per device
run time = every time the application
is launched
Everything done in a previous step is considered static in
the context of the current step, while everything we are
currently doing is
dynamic - ie changing something,
otherwise we wouldn't be doing it!
Instead
of arguing over the semantics of whether install
time is static vs dynamic,
would it not be possible to focus
on the fact that there are 3 steps here
whereas by only
talking about static vs dynamic the patent implies only 2
steps,
ergo dalvik doesn't practice the claims?
Probably too late for that
now. In any case can a
technically ignorant jury, reasonable as they are,
really be
expected to identify truth from the duelling experts
scenario, any
