The difference is that there doesn't seem to be even a single software patent
that should be valid. I'm not going to say "is", because that's
dependent on court decisions, and I have NO faith that court decision on
software will be reasonable. Most people can't afford the kind of lawyers that
Google, IBM, and Novell used.
I think it's proper that the court system has stopped even using the word
justice to describe it's actions. Justice doesn't have that much to do with it.
It's mainly balance of power. (With, admittedly, a bit of weight being
exercised by justice, if the powers are nearly equal.)
In a way this harkens back to the original purpose of the court system: To
ensure that no lord powerful enough to field an army that could challenge the
king would have grievance enough to cause him to do so. This improves the
stability of the society, and is thus a positive good. But it doesn't have much
