I think it is entirely possible that software patents will
disappear. For starters, they have to disappear eventually
if the courts are to keep patent policy self-consistent,
namely that mathematics and algorithms can't be patented.
The recent Mayo/Prometheus case tossed out a big chunk of
similar trolling in the biotech industry.
But even barring a "sudden outbreak of common sense", there
is also the reality that many big, monied interests are
getting robbed by current software patent laws. You can bet
that all the corporations paying Microsoft's Android
extortion fees would be delighted to see those expenses go
away.
In other words, the "evil ones" may wind up turning against
the idea of software patents simply because they are cutting
