He tends to
paraphrase and repeat what other people have said. It really doesn't come
through well on the transcript, and this is another of those places where the
audio recording would be much better. I'll try to format it the way it would
have been spoken.
In terms of the opening statements, there was
one statement made by Microsoft's counsel about this case not having been filed
for a certain number of years, nine or ten years after the event, to reflect or
put the suggestion that, "look, if this was a problem why didn't
you file suit earlier. It is fair game to say why didn't you comment earlier,
why didn't you criticize it earlier, and that is a matter of evidence for you
all to decide."
Don't worry about when the suit was filed.
They acted within their rights. It is a long time, but there are reasons and
limitations were tolled and they acted within their rights in not filing a suit
for whenever they filed the suit. Just disregard that part of the opening
statement.
It doesn't look right in the transcript, but it
satisfied Mr. Schmidtlien enough that he said "Thank you", not "Objection!" [ Reply to This | # ]

I was talking to the President and CEO of a software company in 1996, and
I complained to him about the late release of their WIN95 product. He told
me that Microsoft refused to provide them a copy of WIN95 until the week
before it was shipped.
It just so happens that one of their products competes with a Microsoft
product. Makes you wonder, doesn't it?
And no, I won't name the person or the company.
