I think the reason they could not start from scratch is that the caliber of our
current legislators is such that no decent law could be passed, for most any
issue. That ACA law is most probably 900 pages of Political Pork and 74 pages of
American Care health reform. I remember when I read it, I was many hundreds of
pages in before I saw the first mention of anything health related. A lot of
pork was added just to get politicians to sign up for it.

With respect, here in the UK, we did build a new health system from scratch with the formation of the NHS after the Second World War.

It replaced what was, arguably, then an effective local publicly-funded provision for those unable to afford healthcare with a national system. I doubt, though, that the local system would have been sustainable into the sort of interventions we have today without massive reorganisation, and probably national funding, at some point.

Whilst I haven't followed the arguments over this Bill in any great detail, I have noticed little discussion over the massive distortion of the job market caused by most people who have health insurance receiving it as an employment benefit, and the constitutional implications of that.

One of the (perhaps) unintended consequences of this law, however, is that for
many employers, it will be cheaper to pay the penalties than to continue their
current health care plans.

I know for a fact that's the case with my employer; it remains to be seen if
they will choose that course of action when the time comes.

I'm pretty sure that's not a Good Thing, any way you want to spin it.
