You exactly make the point. One is greater than two for sufficiently large
values of one.

The affordable care act is not a tax for a very specific definition of tax
applied in one circumstance.

The affordable care act is a tax for a different very specific definition of tax
applied in a different circumstance.

The rationale of the law is about words having very particular meanings under
very particular circumstances. It is exactly this property which makes it
irrational to non lawyers.

This is not putting any judgement on the nature of law (which fundamentally
deals with irrational human activities) or the affordable care act. It is
simply an observation that when it comes to the law, the normal rational rules
of mathematics, computer science, engineering, and science don't apply. Law has
its own rationalle (which you are so very good at explaining to us).
