The difference I see between what Chief Justice Roberts said and the medical
coverage for Social Security is that I don't see anyone claiming that the
requirement to buy medical insurance is justified under the Commerce Clause.
PJ, is it not the case that obtaining the coverage is a requirement for
receiving the Social Security benefits, and your mom had the choice of not
participating at all and not receiving the benefits? That would make it not be
an example of what Roberts said had never been done, Congress using the Commerce
Clause to force someone to create a commerce transaction to purchase a product
where there had been none.[ Reply to This | Parent | # ]

No, she was forced. You do not have an option
once you sign up for SS. [ Reply to This | Parent | # ]

I believe you are talking about Medicare.
That is different from Social Security but
kicks in about the same time.
