By that reasoning, the companies would be well within their
rights to charge you more if you
1. drive (choice that increases injury risk)
2. fly (choice that increases injury risk)
3. eat anything other than a vegan diet
4. visit any place where disease is rampant (i.e., pretty
much anywhere on the planet) since you increase your risk of
illness
5. go outside for any reason - increased risk of injury and
illness
6. say inside for any reason - increased risk of injury and
illness
etc. etc. etc.
Gotta draw the line somewhere, and seems tobacco is a
reasonable line, although I would not argue the point that
perhaps even that crosses the line. But tax the tobacco
companies like crazy for selling a known carcinogen and

I think that everyone who drives 75 miles an hour instead of the legal limit of
70 on the interstated should not only have to pay more insurance for themselves,
but should also have to pay more insurance for anyone else on the road that they
pass.
The point of the parent, I believe, is "Where is that line being
drawn?" The fear (at least mine) is that, if that line is not specified,
it gives an open invitation for the servants of our country (ie, "the
government") to pilfer the freedoms and rights of their masters (ie,
"We the people").
