Maybe it was a rhetorical question, but that's right. Gerard
Magliocca wrote an article on trolls a few years ago that
posits you will see a rise when patents are easy to get...

Note that it's not all software. In fact, a lot of it is not
software. Individuals and small companies can and do invent
other stuff.
