The record seems to indicate that Judge Motz forgot his line of thought from day
to day in court. The 'you have lost this case' outburst late in the trial might
have been bias, or it might have been more forgetfulness.
He was insightful in spotting the pretext nature of Bill Gate's testimony and
his analytical and legal skills seem intact.
I am minded to think that the judge's outbursts and inconsistent approach is a
symptom of failing short term memory. During the trial, he had to be reminded of
his own opinion in an earlier trial between the same plaintiff and defendant. If
this is what is really happening, I can see how someone of his skill and ability
would not want to believe how serious the issue was getting and might rail
against the people he is working with.
