What surprises me is that there is no mention of the fact that it was copied
only to test a sort module that was in fact offered and included in the official
version of Java. The Java(tm) codebase benefited by the very action that
introduced this artefact. Now perhaps, as a mater of law, this detail might not
be significant, but it should be clear from the circumstances that it was not
"intentional" copying for reasons of conversion. It was simply used to test the
code that would be adopted by the JSR.

What "nobody in the right mind" would do is not directly relative to how the
Law actually works.
