The maximum penalty is often referred to as 10% of income, revenue or profits.
It is a much more serious 10% of corporate turnover. It was structured that way

It might have dawned on them that their cash flow is
probably going to be a lot lower in the near future.
MS is struggling to stay profitable and is laying off
people by the thousands, so a fine in the order of
billions will hurt them a lot more now than it did a
few years ago. They still have plenty of cash, but
their pockets don't fill up as quickly any longer.
The fine won't kill them, but that is not the point
of a fine. The point is to make it hurt enough for
the culprit to stop doing whatever it is that causes
the fines.

Would needing to provide choice apply to Cell PHONEs too (they are computers)?
