Don't see how they could be forced, as long as they're operating out of a
country that won't just let the USA run all over their local laws.
So not New Zealand, the UK, most of Europe...[ Reply to This | Parent | # ]

Which is why I can't understand why Obama didn't veto the
ban on Galaxy Tab 10.1, with Samsung being one of this
country's largest employers of Engineering graduates in
Texas.
They also have their Main US headquarters in New York,
Mining in Pennsylvania, R&D facilities in around 5 or 6
states and their Mobile Division is headquartered just
outside Dallas. Along with chip works in Florida and Samsung
Heavy Industries and Construction projects all across the
US. They're also building the first and only Compressed
Natural Gas Containment Facility in Canada at a cost of 55
Billion Dollars! ....this is no iToy company like Apple.
They built The Burj Dubai Tallest Skyscrapper and a big
majority of Offshore Oil Platforms, including the largest in
the World!
If Apple won this asinine lawsuit, it'd also be at America
and Apple's expense. Because their most likely first move
would be to suspend operations in Austin, Texas. They are
already preparing for such an outcome, by Spending $42
Billion this year alone on CAPEX. That's 2nd to only Intel
Globally and Intel is also spending record amounts on CAPEX.
Which is upgrading and building new manufacturing and
assembly plants.
Samsung is already working with China to build their first
World Class Semi-conductor plant in that country. To the
tune of 6 Billion there in just one venture this year. They
know that they must be on the right side of the Chinese,
since they are now the largest smartphone market in the
World topping America. AND... Apple is barely a blip in that
market. Where Samsung is #1 followed by Nokia and Chinese
ZTE and others!!!
Do the Judges working these cases realize this? I don't
think so!!! ...1000's of Top Paid Engineering Jobs would
leave the country and I don't think even Apple realizes what
that would mean. Because Samsung Leases all their space in
Austin, Texas, besides loaning them many engineers. The
effects would be catastrophic to the State of Texas alone
and we're not talking about just anyone being able to make
these chips. Apple would have to change from Samsung/IBM
Gate First HKMG process to Intel/TSMC's Gate Last process
over night and that's around a 8 to 9 month redesign at
least! [ Reply to This | Parent | # ]

Protectionism, like chauvinism and racism, is a natural urge. It has localized
benefits and causes wide-spread damage.
So it is a matter of civilization (and/or Kantian ethics) to keep those urges
under proper control and make people realize the cost of short-circuiting
thinking about the ultimate consequences. Or at least teach them to be ashamed
when doing the wrong things, even if they don't fully comprehend.
Shaming law making processes and businesses is quite harder than shaming
individuals, though.[ Reply to This | Parent | # ]
