Legally, wasn't sco/tsg holding Novell's license revenue money "in
trust"? Looks like they spent cash that wasn't theirs to spend, which
suggests criminal nonfeasance (the omission of some act that ought to have been
performed, like paying Novell) or possibly simple embezzlement.

I think that was the term when Novell (trying to do this
from memory) filed in the SCO case, in such a way that they
could go after money that was already paid to professionals.
I wonder if that is part of the appeals process or if that
is something that would cause the Judge to think twice about
keeping the Chapter 11 trustee (who still failed to file a
reorganization plan?), from becoming the Chapter 7 trustee.
(or give Novell right of recourse, maybe long term, too much
sun today)
