No, of course I don't disagree with
trademark law. GM should not be
able to put a VW badge on its cars.
On the other hand, all small hatchbacks
look very much alike. Toyota should not
be able to sue Nissan for making a hatchback.
Apple is not even claiming that Samsung
makes a tablet that looks too much
like an I-pod (even if there was
a legal theory that makes that wrong).
Apple is claiming that Samsung violates a
very vague design patent that says little
more than thin
rectangle with rounded corners.

I disagree with you on this, The Samsung tablets and phones were and are quite
different in shape and size, especially the newer ones with 4.x" screens. If you
put the galaxy S II or III next to an iPhone you can't tell me that anyone with
an slightly below average (or greater) IQ is going to confuse them, (this
applies to the 10.1" tablet and iPad as well). I'm sorry but they are completely
different in look and feel. most of the Samsungs are larger than the apples.
Apple copied others to create all of their products, now they want to sue
anyone that even comes close to resembling their's. I think this
article sums it up the best.

Rounded corners are functional. They reduce the possibility
of causing harm to people, plus less likely to chip off if
they fall.

I take it you haven't ever seen the "designer" iPads that various high end
shoppes sell.
I'll grant that they are Gold with Mother of Pearl trim,
rather than yellow and
