If a compelling fiction weren't more intriguing and easier to believe than raw
truth, most of us would have different social lives, even different parents.
Deceit is fundamental to enormous parts of both our economy and ecology: go
study Wolfgan Wickler's "Mimicry" book for a wonderful review of its
role in ecologies and evolution.[ Reply to This | Parent | # ]

Were I ever to serve on a jury, I wouldn't pay any heed to the attorney's spin
moments. If I was deciding law issues, then it might be important to hear them
speak on the law, but there's really nothing they have to offer in the area of
facts. I wouldn't trust either lawyer to give me the facts. That's not only not
necessarily in their best interest, it not their job, and on top of which one or
both are in the wrong and trying to not reveal certain facts. How does one
decide who's lying and who might not be? If I'm deciding facts it's the evidence
and the testimony and what weight each gets, along with a good measure of common
sense, and who is more likely to not be stretching the truth.
Of course, this will be a hard case for Samsung, because they weren't allowed to
present mountains of evidence to support their case. Very one-sided. But I guess
the judge had to allow at least one or two pieces of defense evidence. I
forecast a big win for Apple, and a very long appeal process, and a more fair
retrial in about 2 years. At which time Samsung will finally be able to clear
their name. If it isn't then too late. Seems that Samsung is the party that will
suffer the most harm, intentionally inflicted by Apple.
I can predict who will get my business in the future and who won't. But, then
I've never really cared much for Apple. Always seemed a bit too greedy. Now I
have the ultimate proof. [ Reply to This | Parent | # ]
