So these are _punitive_ damages then?

You picked up on that, too, huh? It gets even better, of course: the relevant quote from the interview is:

And to what extent were you aware that because it was wilful, that the judge could now treble the damages, or was that not a concern?

We were never privy to that. There are a lot of things in the trial that we weren't privy to.

I only skimmed the jury instructions, but I clearly remember the following bit:

You will also need to make a finding as to whether the infringement was willful. If you decide that any infringement was willful, that decision should not affect any damage award you give. I will take willfulness into account later.
