"No reasonable jury" means that in the judges opinion the only way for
a jury to have returned this verdict would be for them to have been
*unreasonable*. (A synonym in this case would be 'unreasoning', not
'pig-headed'.)
You have a patent on a uniquely pink gizmo, and are claiming that your
competitor's green gizmo infringes on it. In another case, you claim your
competitor's light red gizmo infringes on your pink gizmo patent. ('Pink',
'green', and 'light red' here are standing in for applicable
functionality/design claims).
It would take an unreasonable (aka: unreasoning) jury to claim that 'green'
infringes on 'pink'. It would not, however, take an unreasonable (aka:
unreasoning) jury to claim that 'light red' infringes on 'pink'. However, a
reasonable jury *could*, still rule that the particular 'light red' does not
infringe on your 'pink'.[ Reply to This | Parent | # ]
