My philosophy.

Don't start battles. Aim to avoid them. If you get involved, go all out to win.

So, Red Hat can sink them, either by refusing to settle at all and obtaining a
permanent injunction, or by refusing to license their GPlv2 code. Even if Red
Hat chooses not to do either of those things, what are the chances that another
author of code they've (allegedly) stolen will refuse to license to them? I'd
rate that as a near-certainty, even if Red Hat chooses to be magnanimous.

They must appease not only Red Hat, but *every* author of GPL code improperly
included in their product. That's a very tall order, one they are unlikely to be
able to fill.
