In spite of videos and Tweets, we know that media reporting, questioning and
editing of videos sometimes slants the issue in the attempt to get punchy,
newsworthy content.
People just don't watch tediously factual and on-point news reporting... Hey,
are you listening to me!
Going by PJs and others comments, an interview of jurors by the judge is well
within due process. Judge Koh is a patently smart lawyer who can ask all the
right questions and understands the purpose of the jury instructions she gave.
I don't think she ran this complex and difficult case well. She is not
experienced in dealing with two sides equally as capable as herself of plotting
ahead to their own advantage. The steady way she proceeded after the appeal
court set-back suggests to me that she has Alsupian potential.
She has a whole range of problems to deal with: let's see her using her legal
interviewing skills on the jury members to find out whether what they actually
did during their considerations was sufficiently outside of their instructions
to make their findings legally unsafe.
Then she can deal with the further issues raised by Samsung that were not of the
jury's making.
