I do have a problem with actors/actresses getting a piece of the copyright.
They are working for pay. Your example of cover bands, the band is working as
an independent contractor and not specifically being payed to produce something
protectable by copyright so it's not the same thing at all.
For everyone working outside of the entertainment industry, under the work for
hire doctrine anything you produce that is protectable by copyright is the
property of your employer, you don't even get a small piece of it.
Even for IT contractors, if you are working for a contracting firm rather than
as an independent contractor, the copyright in any code you write belongs to
either the client or the contracting firm depending on the agreement between
those two entities.
Why should actors/actresses be any different. It's not like they are creating
their own works on their own time. The are always working for someone else.[ Reply to This | Parent | # ]
