It will be interesting to see what happens with the appeals
process in Germany.
The wheels in court may grind slow but they tend to grind in
germany. I'll bet my 5 cents as soon as the presidential
election in the states is over MS will receive a ruling to
stop shipping at least to germany in a bit, whatever US courts
try to enforce.

The German injunction has already issued, and the US District court order
(now
affirmed on appeal) prohibits Motorola from enforcing it until the US
case is
decided.
The interesting thing will be to see if Motorola
seeks monetary
damages for patent infringement in Germany, something the
appeals court
specifically said Motorola could still do. --- Jim

It seems to me ...
That the US court seems to believe that it can order Motorola to licence the
patents to M$ but surely a US court cannot order a Worldwide licence, even if
under some strange reading of US law the patent must be licensed it surely
doesn't mean it has to be under German law. So M$ could win in the US and
Motorola could still go to the German court and get Xbox banned in Germany. Or
if the court says Motorola cannot they can sell the patent to a European troll
who has no such problem.
