Well yes. The German board is subject to German jurisdiction for its actions in
Germany. Anything else is unacceptable extra-territoriality.
What scenario were you thinking of? In this actual case, the court had authority
to order Motorola US to tell Motorola Germany what to do. And Motorola US had
the authority to do what the court said.
In MY HYPOTHETICAL scenario, the court was ordering a subsidiary to tell its
bosses what to do. What would happen if you told your bosses what to do? I guess
you'd probably get fired, or at least disciplined for overstepping your
authority.
In this real case, the court ordered Motorola US to use the authority they had.
If the court had ordered them to do something they had no authority or power to
do, then yes we would have had cause to complain about the Judge overstepping
his authority.
