The mean income in the US compared to the mean income in those place to
mentioned is bigger by orders of magnitude.
To give students in these comparatively low-income countries a chance to access
up-to-date textbooks and have an equal opportunity to progress it makes sense to
price textbooks for the local market (by printing locally, say).
It also means that those foreign students smart enough to go on to study abroad
will have acquired a standard level of knowledge and therefore have an equal
opportunity - at least in terms of learning.
To take advantage of this by re-importing these textbooks back into the US for
personal gain is to do a gross disservice to both (foreign) students,
publishers, and, indeed, society at large, as this lawsuit threatens to turn the
concept of 'rights' on its head as a consequence.
As for your comment on subsidising, I'll just say that it's better to supply
them with books than with guns, just like it's more forward-looking to build
schools than bomb villages.

The books could be printed anywhere and probably are, the copyright holder would
still be whining. The music industry in Australia spouted same line in the 80's
about grey market music. I was buying it at the time and it was 30% more
expensive and was never pressed in Australia yet we got the same story that
Wiley just trotted out.
A fair portion of my current music has "not for sale outside xxx on it or
not for sale in xxx" yet this music has never been offered for sale in
Australia.
The problem with claiming that this is covered by copyright law is that it
invites the sort of control freaks that the computer software industry has way
too many of.
If this is a problem then it should be a trade issue, so much of US industry has
gone east with barely a murmur I fail to see why printing is suddenly an issue.
