It is my understanding that the ball is in Motorola's court in the German case.
The German court has ruled that Microsoft is infringing, but Motorola must step
up and request the injunction to ban the sales of the Microsoft products in
Germany. Meanwhile, the US court has ordered Motorola to not go forward with the
German case, so the German court is merely waiting for Motorola to go forward
with the request for an injunction, which Motorola will not do until the issue
in the US court is cleared up or else they would face contempt of court and/or
sanctions in the US court. I don't think that there's anything public that the
German court could or would say about the matter. In their eyes, officially,
Motorola has not requested the injunction so the German court is doing nothing.[ Reply to This | Parent | # ]
