US courts have a history, backed by US governments, of not understanding that
there is a World out there. The US judge should simply have said to M$ you can
easily avoid the injunction in Germany, just stop selling there.
Look at a parallel case Apple, having started a case in London under EU law
decided to run around the edge and get an injunction in Germany. The UK court,
acting as an EU court and superior in this matter to the German court did not
rush to block the German court, Samsung obeyed the injunction even though as the
final UK ruling made clear the injunction had not been legally correct and
should never have existed.
M$ and the US judge are deciding that US law trumps all others, I wonder if a
Chinese court would take this lying down ...
