The "UK" site proudly (sic) contains:
Web Site Publication
Manager:
Cathy Kearney
Web site Hosting Service
Provider:
Apple Inc., Infinite Loop,
Cupertino, CA
95014
It is clearly in the US (www.apple.co.uk resolves to US
IP addresses). If Apple requires 14 days to change the contents, then they are
suggesting that either Cathy or her team are incompetent; or they may be trying
to hide behind their terms and conditions:
Disclaimers
APPLE
DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE OR FEATURE OF THE SITE
WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE
CORRECTED...
Obviously intended as terms against someone using the
site, especially someone signing up for an account, other terms make interesting
reading:
Governing Law; Dispute Resolution
You agree that all
matters relating to your access to or use of the Site, including all disputes,
will be governed by the laws of the United States and by the laws of the State
of California without regard to its conflicts of laws
provisions...
The EU Court of Appeals is not in US (state of CA),
so its judgements are non-binding...
The link has now disappeared from the
UK home page - Obviously had to replace the UK home page, so why not just
replace it with one with the required text?
Or is the 14 day delay Apple
wanted because they want to run the text through their legal department that
runs at the speed that US legal institutions seem to run, or rather glacially
crawl? (The SCO saga lasted how long in US but how long in Germany when required
to give evidence or shut up?) The text was issued by a court and is
required to be displayed by a court order, so there is no need to have legal
check it out: they can just pass any complaints straight to the court judgement;
unless they're trying to see how they could "edit" it (but failed when they last
tried). [ Reply to This | Parent | # ]
