On many matters, such as this, Scotland has tended to come to similar legal
conclusions long before the EU became involved in UK law. The terminology and
court procedures are different north of the border, but most business-related
law is governed by the same acts of parliament, which usually contain a few
special clauses which apply in Scotland, to fit in with their legal framework.
Older laws differ, sometimes greatly, but things like patent disputes are likely
to have the same outcome in either jurisdiction. But as regards this
outrageous behaviour, the Scottish judges are no more likely than their English
counterparts to tolerate contempt in their courts. The threshold for verbal
contempt may be slightly higher, due to social and linguistic differences, but
simply defying a court order, as in this case, would end up in the same way, a
