Well, each device manufacturer will need to customize their android install,
even if it's just device drivers and so on, so that probably gives Apple all the

Actually, the way that current patent law is in the US, a patent holder can sue
the maker of an allegedly infringing software program or device, a bundler who
bundles the allegedly infringing software or device with other products and
resells it, or even the end user who purchases an allegedly infringing product

It's called 'Patent Exhaustion'. If Google had a relevant license then Samsung
can claim they don't need one. Otherwise Apple can sue anybody further down the
chain.
Patent Exhaustion is a defense. It doesn't stop you getting sued in the first
